PRIVACY POLICY OF IES ITALIA WEB SITES


Privacy policy on the protection of personal data of users of the IES ITALIA websites pursuant to Articles 13, 14 of the EU General Data Protection Regulation 2016/679


With this policy IES Italia S.r.l. (following "IES Italia", "we", "our"), intends to inform users who are visitors of the websites ies-italia.it, seafy.com, portal.seafy.com (following the "IES Italia Sites") of the policy adopted regarding the protection of personal data, underlining its commitment and attention to the protection of the personal data of the users of the Sites. Please read carefully this privacy policy (the “Privacy Policy”) which applies in case you access the Site and decide to navigate within it using our services.


Browsing within the Sites is free and does not require any registration, with the exception of certain areas in which the user may freely and expressly provide a set of data concerning him or her in order to access specifically identified services (e.g. to request information through the “Contact Us” section, to subscribe to the newsletter, etc.). Where, therefore, you intend to provide your personal data in order to access these additional services, you will be expressly informed in accordance with Regulation (EU) 679/2016 General Data Protection Regulation (the “Regulation”) with an indication (by way of example) of the purposes and methods of data use by IES Italia as well as the right to request at any time the deletion of the data or its update.

Pursuant to and in accordance with Articles 13 and 14 of the Regulations, IES Italia provides you with the following information.

a. Identity and contact details of the data controller
The Site is managed by IES Italia S.r.l. with registered office in Via L. Canonica, 29, Milan (MI), Italy, Tax Code and VAT No. IT07580910961, e-mail privacy@ies-italia.it, as data controller under the Regulations.


b. Categories of personal data
To access the Site, no registration is necessary. There are, however, sections within the Site that require personal information such as first name, last name, e-mail, and/or phone number (e.g., to access newsletter services, to request information, for assistance, etc.), and to register for the Site. [1].


With reference to data related to navigation within the Sites, see also point g. below regarding profiling tools used by the Sites.


c. Purpose for processing
Data are collected and processed for purposes strictly related to the use of the Sites and its services. The purposes of data use are detailed in the specific notices provided by the Sites in all cases of data collection. We therefore ask you to be willing to read the information notices that from time to time illustrate the characteristics of the processing that will be carried out by IES Italia (e.g. for subscription to the newsletter service, for Assistance through the chatbot, user registration, etc.). In particular, your data will be processed to manage the fruition of the services (including after-sales services, relating to the management of the service) requested through the IES Italia Websites, to fulfill related legal obligations, to respond to your possible requests of any request of information about our service.

For any marketing activity or for any analysis of your preferences and for selling you personal data to business partners, these will be put in place by the Data Controller solely on the basis of your consent, that may be freely granted using appropriate request fields located in the various forms on the Sites, or by authorizing the installation of Cookies, as described in the Cookie Policy document. , as well as, based on your consent, to put in place marketing activities and analysis of your preferences.


The processing of your data will be carried out in full compliance with the European legislation on personal data protection [2].


d. Legal basis of the processing
The legal basis for the processing of your surfing data on the IES Italia Websites will be the implementation of the contract of sale with you and of the related services and the fulfilment of the related legal obligations pursuant to art. 6, paragraph 1, lett. b) and c), of the Regulation.


On the IES Italia Websites there are services and sections available in order to update you about our services, initiatives and events, to send you promotional material, also personalized (according to the category of users), for which you will find specific information and, if necessary, we will activate the collection of your explicit consent (pursuant to art. 6, paragraph 1, letter a) of the Regulation). Your consent is always, freely revocable (cf. letter h. of this information notice) without prejudice to the lawfulness of the processing prior to revocation, also by using the link in all our newsletters or by writing to the e-mail address privacy@ies-italia.it


e. Optional provision of personal data
The provision of personal data is generally optional. Only in some cases, failure to provide data may result in the denial of access to specific services or the impossibility for Berlin Packaging Italy to respond to your requests.

The data requested from time to time in the collection forms on the Site are those strictly necessary to provide the relevant service requested.

f. Method of data processing and scope of communication
Data may be processed both electronically and on paper Berlin Packaging Italy guarantees the lawful and correct processing of the personal data provided through the Website, in full compliance with the legislation in force, as well as the maximum confidentiality of the data provided.

The data shall not be disseminated and shall be processed by persons expressly authorised to manage the Sites and the “users” data base.

For purely organisational and functional reasons, IES Italia has appointed a number of service providers functional to the management of the Site as external data processors for the processing of users' personal data for purposes strictly connected and related to the provision of the services provided. A full list of external data processors can be obtained by contacting privacy@ies-italia.it.

The data may also be made available to the other companies in the Berlin Packaging group as well as to companies that provide us with services [3].

g. Links to other sites
This notice is provided only for the Sites of IES Italia and not for any other websites that may be consulted by the user through links. IES Italia cannot be considered responsible for personal data provided by users to external parties or to any websites linked to these Sites.


h. Profiling and/or personalisation tools
IES Italia does not carry out any promotional and/or advertising activities without the user's prior express consent. The Sites uses "cookies", both technical (i.e. to facilitate navigation and use of the Website) and profiling (i.e. to analyse users and their behaviour and preferences, and to provide them with personalised advertising). Profiling cookies will only be activated with the express consent of users. For a detailed explanation of the cookies used by the Site and how to disactivate them, please read our Cookie Policy.


i. Who processes your data
Your data will not be disclosed or transferred to third parties for a fee. The personal data entered in the collection forms on the site will be disclosed (limited to their respective sphere of competence) to persons authorised to process the data in the marketing, purchasing, finance and legal departments. The data may also be shared with our business partners as well as with companies that provide us with services [3] useful for handling your requests.

j. Place of data processing and transfers outside the European Union
Processing related to the services provided by the Website are managed at the headquarter of IES Italia.

Data collected and processed through the Sites will not be transferred to countries outside the European Union.


k. Period of data retention
Your data will be processed for the time periods provided for in the specific information provided at the time of collection [4].

l. Rights of data subjects
By means of a communication to be sent to privacy@ies-italia.it, you may at any time exercise your rights [5] as set out in Articles 15 to 22 of the Regulation, including knowing what data we are processing, how and for what purposes we use it, modifying the data you have provided us with or deleting it, asking us to limit the use of your data, requesting to receive or transmit your data, without prejudice to the possibility of changing your consents (if any). You can also always object to the processing of your data, in particular for marketing purposes or the analysis of your preferences.


m. Who you can complain to
We remind you that, if you consider that the processing of your personal data violates the provisions of the Regulation, you may always lodge a complaint with the Data Protection Authority (www.gpdp.it), or, if different, with the Data Protection Authority of the Member State in which you habitually reside or work or of the place where the alleged infringement occurred.


n. Applicable law
This Privacy Policy is governed by the Regulation, which ensures that personal data is processed in accordance with the fundamental rights and freedoms and the dignity of the data subject, with particular reference to confidentiality, personal identity and the right to protection of personal data.

o. Revision clause
IES Italia reserves the right to revise, modify or simply update, in whole or in part, at its sole discretion, in any manner and/or at any time, without prior notice, this Privacy Policy also in consideration of changes in laws or regulations on the protection of personal data. Changes and updates to the Privacy Policy may be notified to users as appropriate by (i) sending e-mails to registered users of the Site; and/or (ii) publication on the Site's home page, and will be binding as soon as published and/or communicated. We therefore ask you to regularly access this section to check the publication of the most recent and updated Privacy Policy or to check your e-mail inbox. [1] in the event that IES Italia acquires information and personal data it will, from time to time, inform users in advance of the purposes for which such data is required and the manner in which it will be used. Where necessary, IES Italia will obtain the user's specific consent to the relevant use of the data. By way of example, personal data such as name and surname, telephone number, e-mail address and other information that the user agrees to provide in order to use the services of the Website by filling in a specific registration form may be requested. IES Italia will use the personal data collected online solely for the purposes indicated at the time of collection.

The data relating to the connection and navigation within the Site (such as the URI-Uniform Resource Identifier addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user's operating system and computer environment) are collected for the sole purpose of obtaining anonymous statistical information on the use of the Site and to check its correct operation and are deleted immediately after processing.   • pursuant to art. 6, paragraph 1, lett. b) and c) of the Regulation, to manage your orders and guarantee you the use of the services (including after-sales services) requested through the Website, to fulfil the related legal obligations, to respond to your requests, if any;

  • on the basis of your consent, pursuant to art. 6, paragraph 1, letter a) of the Regulations, to carry out marketing activities and analysis of your preferences.

In any case, the processing will be carried out in compliance with the provisions in force - and their subsequent amendments and/or additions - issued by the Personal Data Protection Authority.


[3] Your data will be disclosed to:

  • third party companies for the management of your eventual purchases;

  • third party companies for the user registration, for the customer support through Chatbot and for sending the newsletter;

[4] Your data, provided for contractual purposes and for the execution of pre-contractual measures, shall be stored for as long as is necessary to fulfil the obligations towards you in connection with the business relationship and in any case no longer than ten (10) years after the conclusion of the contractual relationship.

The data processed for the purpose of sending you answers to your enquiries, communications, offers, news and events, marketing communications, will be stored for five (5) years from the date of collection or from the date of your last contact with IES Italia for non-contractual reasons.


[5] Articles 15 to 22 of the Regulation recognise specific rights including:

  • obtain confirmation as to whether or not personal data concerning you are being processed;

  • to obtain access to your personal data and to the information indicated in Article 15 of the Regulation;

  • obtain the rectification of inaccurate personal data concerning you without undue delay or the integration of incomplete personal data;

  • obtain the deletion of personal data concerning you without undue delay;

  • obtain the restriction of the processing of personal data concerning you;

  • to be informed of any rectification or erasure or restriction of processing of personal data concerning you;

  • receive or transmit to another data controller in a structured, commonly used and machine-readable format the personal data concerning you;

  • to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you.


In particular, your right to revoke at any time any processing consents you may have given and to object to our analysis activities remains unaffected. Furthermore, pursuant to Art. 21 of the Regulation, you shall have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you carried out in pursuance of the legitimate interests of the controller pursuant to Art. 6, paragraph 1, letter f of the Regulation.

NEWSLETTER PRIVACY POLICY


Pursuant to Art. 13 of EU Regulation 679/2016 General Data Protection Regulation (GDPR)

a. Identity and contact details of the data controller
IES Italia S.r.l.with registered office at Via L. Canonica, 29, Milano (MI), Italia, VAT Code n. IT07580910961, e-mail privacy@ies-italia.it (hereinafter “IES Italia”, “we”, “our”), is the company that, as data controller, collects and processes your personal data, pursuant to EU Regulation 679/2016 (‘General Data Protection Regulation’) (the ‘Regulation’).


b. Purpose of processing
The data that you are providing by filling in the electronic form on the website seafy.com (the "Site") are necessary for us to allow your subscription to the newsletter SEAFY di IES Italia and to update you by sending you promotional material (by e-mail) general information on our services and new initiatives, as well as to carry out market research (to better understand your interests and to be able to improve our offer). We may also send information or promotional communications relating to events and initiatives organised on board the ships where the service is provided.


c. Legal basis of processing
The legal basis for the processing of your data is your consent in accordance with Art. 6 paragraph 1 letter a) of the Regulation.
In order to be able to update you on our products, services, initiatives and events, to send you promotional material, also personalised according to your country, or to carry out market research, we need your explicit consent (pursuant to Art. 6, par. 1, letter a) of the Regulations). In addition, if you provide your consent, IES Italia may use your purchasing preferences to provide you with offers tailored to your tastes and needs. If you do not give your consent, we will not be able to proceed with your registration for our newsletter. Your consent is freely revocable (see letter h) of this notice) without prejudice to the lawfulness of the processing prior to revocation, including by simply using the link in all our newsletters or by writing to  e-mail privacy@ies-italia.it.


d. Mandatory data
We ask you to provide all the data requested as "mandatory" (e-mail address) because it is necessary for your subscription to our newsletter; if you do not provide this data or if it is incomplete, your subscription cannot be completed.


e. Methods of data processing and scope of communication
Your data will be processed electronically in compliance with the regulations in force, in accordance with the requirements of the provisions in force - and their subsequent amendments and/or additions - issued regarding the protection of personal data, and, in any case, in such a way as to guarantee their security and confidentiality and to prevent their unauthorised disclosure or use, alteration or destruction.


Your data will not be disseminated. In order to allow you to receive our newsletter and to be contacted by IES Italia, your data may be disclosed (limited to their respective sphere of competence) to the persons authorised to process the data, as well as of the companies which provide us with services [1] useful for the management of our Site or which carry out marketing activities on our behalf.


f. Data retention period
Your data will be processed for the duration of your subscription to our newsletter service or - in any case - until you revoke your consent (which can be requested at any time, also using the link in all our newsletters); thereafter, the data will be deleted or anonymised.[2]


g. Place of data processing and transfers outside the European Union
Processing related to the services provided by the Sites is carried out at the premises of IES Italia.

Data collected and processed through the Sites will not be transferred to countries outside the European Union.


h. What are your rights
By means of a communication to be sent to privacy@ies-italia.it you may at any time exercise your rights [3] as set out in Articles 15 to 22 of the Regulation, including knowing what data we are processing, how and for what purposes we use it, modify the data you have provided us with or delete it, ask us to restrict the use of your data, request to receive or transmit your data to another processor.
You can also always object to the processing of your data, in particular for marketing purposes, by using the link in the footer of the newsletter to unsubscribe.


i. To Whom You May Complain
We remind you that, if you consider that the processing of your personal data violates the provisions of the Regulation, you may always lodge a complaint with the Personal Data Protection Authority (www.gpdp.it), or, if different, with the Data Protection Authority of the Member State in which you habitually reside or work or of the place where the alleged violation occurred.

E-COMMERCE PRIVACY POLICY


Pursuant to Art. 13 of the EU General Data Protection Regulation 679/2016 (the ‘Regulation’)

a. Identity and contact details of the data controller
The e-commerce on the Websites portal.seafy.com  and seafy.com ( “websites”) are managed and owned by IES Italia S.r.l. (“IES Italia”, “we”, “our”), with registered office at Via L. Canonica, 29, Milano (MI), Italia, VAT Code n. IT07580910961, e-mail privacy@ies-italia.it, is the Data Controller pursuant to General Data Protection Regulation (the "Regulation").

b. Purpose of the processing
The data you are providing us by completing the purchase process on the Site are necessary for:

  • complete the sale of the products you have selected and fulfil the contract concluded with you, as well as exercise our related rights, including in court;

  • comply with legal obligations, regulations and EU legislation relating to your purchase (e.g. tax, accounting, anti-money laundering, anti-fraud);

  • to manage the services connected to your purchase also in the post-sales phase (e.g. customer service).

  • to send by e-mail commercial communications, advertising and promotional material for the direct sale of its products similar to those purchased by you, without your consent, in accordance with the Regulation and the provision of the European Authority and the Law on Information Society Services and Electronic Commerce (“purpose of sending communication “soft spam”");


c. Legal basis of the processing
The legal basis for the processing of your data will be the execution of the sales contract established with you and of the related services and the fulfilment of the relative legal obligations pursuant to Article 6, paragraph 1, letters b) and c) of the Regulations.


d. Your consent
The processing of your data will take place without the need for your consent, pursuant to Article 6, paragraph 1, letters b) and c) of the Regulation. However, in order to receive commercial offers and discounts eventually related to your purchasing preferences, it will be necessary to give your consent to profiling during the activation of your account pursuant to Art. 6 letter a) of the Regulation. You will not be able to benefit from a dedicated discount without consenting to profiling, as we will not be authorised to screen your preferences.


e. Optional supply of personal data
We ask you to provide all the data requested as " mandatory " (generally indicated with *) because it is necessary for the management of your purchases and the services connected to them (e.g. delivery); if you do not fill in all or incompletely, your purchases cannot be completed. Failure to fill in the data indicated as 'optional' will have no consequences.
If you provide data of third parties (e.g. your family members, other customers or potential customers), you must ensure that these third parties are informed and have consented to the use of the data as described in this policy.


f. Method of processing your data
Your data will mainly be processed by computer in order to manage your purchases. In addition, the processing will be carried out in compliance with current legislation and, in any case, in such a way as to guarantee its security and confidentiality and to prevent its unauthorised disclosure or use, alteration or destruction.

Your data will not be disclosed or passed on to third parties for remuneration. In order to manage your purchases, the personal data entered in the fields of the online shop will be disclosed (limited to their respective sphere of competence) to persons authorised to process the data in the marketing, purchasing, finance and legal departments. The data may also be shared with our business partners as well as with companies that provide us with services [1] useful for managing your purchases and related services.


g. Period of data retention
Your data will be processed for the time necessary for the management of your purchases and related services (e.g. Customer Service), as well as - limited to the necessary data - for the time required to comply with legal obligations regarding tax and accounting matters [2], after which the data will be deleted or made anonymous.

Should you decide to proceed with purchases, you will have to create your customer account by registering in the My Account section, and your data will be processed as long as your account is active. You may close your account at any time and your request will be handled immediately or, in the case of a pending purchase order, immediately after it has been executed. Should your account remain inactive for two (2) years, IES Italia will contact you to find out whether you wish to maintain or close your account. If you do not wish to keep your account active, it will be closed and your data deleted.

Your purchase details will, however, be processed anonymously for analysis or promotional purposes.


Your bank details are only processed and stored securely by the operator of the payment service you have chosen (Banca Sella, Revolut) for the time stipulated by national law.

  • newsletter operator (only with your express consent)

Customer Assistance Services on the Web sites portal.seafy.com and seafy.com ( the “Sites”) are managed and owned by IES Italia S.r.l. (“IES Italia”, “we”, “our”), with registered office at Via L. Canonica, 29, Milano (MI), Italia, VAT Code n. IT07580910961, e-mail privacy@ies-italia.it, as data controller pursuant to the Regulation.

The ‘Support’ and ‘Contact’ services may be used by all users of the Sites, without the need to register, using the communication channels made available on the Sites. By way of example and not limited to:

  • complete the sale of the products you have selected and fulfil the contract concluded with you, as well as exercise our related rights, including in court;

  • comply with legal obligations, regulations and EU legislation relating to your purchase (e.g. tax, accounting, anti-money laundering, anti-fraud);

If you provide data of third parties (e.g. your family members, other customers or potential customers), you must ensure that these third parties are informed and have consented to the use of the data as described in this policy.


e. Method of processing your data
Your data will mainly be processed by computer in order to manage your purchases. In addition, the processing will be carried out in compliance with current legislation and, in any case, in such a way as to guarantee its security and confidentiality and to prevent its unauthorised disclosure or use, alteration or destruction.

Your data will not be disclosed or passed on to third parties for remuneration. In order to handle your requests for assistance, the personal data entered in the fields of the online shop will be disclosed (limited to their respective sphere of competence) to the persons authorised to process them in the Assistance, Marketing, Finance and Legal departments. The data may also be shared with our business partners as well as with companies that provide us with services [2] useful for the management of your purchases and related services, including after-sales services.


f. Period of data retention
Your data will be processed for the time necessary for the management of your purchases and related services (e.g. Customer Service), as well as - limited to the necessary data - for the time required to comply with legal obligations regarding tax and accounting matters [1], after which the data will be deleted or made anonymous.

In the case of the Livechat service, the data are deleted when the session is closed.


g. Place of data processing and transfers outside the European Union
Processing related to the services provided by the Sites is carried out at the premises of IES Italia.

Data collected and processed through the Sites will not be transferred to countries outside the European Union.


h. What are your rights
By means of a communication to be sent to privacy@ies-italia.it you may at any time exercise your rights [3] as set out in Articles 15 to 22 of the Regulation, including knowing what data we are processing, how and for what purposes we use it, modify the data you have provided us with or delete it, ask us to restrict the use of your data, request to receive or transmit your data to another processor.


i. To Whom You May Complain
We remind you that, if you consider that the processing of your personal data violates the provisions of the Regulation, you may always lodge a complaint with the Personal Data Protection Authority (www.gpdp.it), or, if different, with the Data Protection Authority of the Member State in which you habitually reside or work or of the place where the alleged violation occurred.

  • object at any time, on grounds relating to his/her particular situation, to the processing of personal data concerning him/her.



In particular, your right to revoke at any time any processing consents you may have given and to object to our analysis activities remains unaffected. Furthermore, pursuant to Art. 21 of the Regulation, you shall have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you carried out in pursuance of the legitimate interests of the controller pursuant to Art. 6, paragraph 1, letter f of the Regulation.
